Marriage Licenses

Marriage licenses are filed in the Official  Records Division of the Clerk’s Office. This division is located on the first  floor of the Kim C.  Hammond Justice  Center, 1769 E. Moody Blvd, Bldg 1, Bunnell, FL   32110. You may contact this division by calling 386-313-4360 or by email marriagelicense@flaglerclerk.com

  • Couple must  personally come into the Flagler County Clerk of Circuit Courts – Recording Division  located in the Kim C. Hammond Justice Center between the hours of 8:30 a.m. – 3:30 p.m. Valid Photo ID is REQUIRED  (Driver’s license, state issued ID card or valid Passport)
  • To shorten the  application process, you may complete the Marriage License application online  by clicking here.  All questions must be completed; any omissions may delay the application  process. Upon completion of this form, the couple must personally come into our  office and complete the remaining paperwork.
  • Florida Statutes  require the couple to read the Florida Bar Family Law Handbook, which is available for  viewing by clicking on the preceding link.
  • Couple must sign  an affidavit, under oath, stating they have read the handbook and whether or  not they have completed a premarital preparation course. If they have completed  a course, they must provide the original certificate from the course provider  in order to receive a discount on the fee and waive the statutory 3-day waiting  period. All area premarital course providers must be registered with the  Flagler County Clerk of Circuit Courts Recording Division. A listing of the  registered premarital course providers can be found by clicking on Flagler County Clerk of Circuit Courts, Registered Premarital  Course Providers.
  • There is a 3-day  waiting period if the premarital preparation course has not been completed.  (Non-Florida residents are exempt).
  • Couple must supply  personal information, i.e. Name, date  and place of birth, Social Security Number or Alien Registered Documentation  Number, number of marriages, exact date last marriage ended and why . Valid  Photo ID (Driver’s License, State issued ID card or Valid Passport) is  REQUIRED.
  • License is valid  for 60 days from issuance date and may be used anywhere in the State of Florida. The license  shows both the effective date and the expiration date.
  • There is a Wedding  Chapel onsite should you wish to be married at the Kim C. Hammond Justice   Center. The cost for us  to perform the ceremony is $30.00. Should you wish to be married in our Wedding  Chapel, you must make an appointment to do so. Appointments are available between the hours of 8:30 – 11:30 am and 1:30 – 3:30 pm. NO APPOINTMENTS will be scheduled between 11:30 am and 1:30 pm Please contact our office  (386-313-4360) to set up an appointment. When applying for your Marriage  License, you can make an appointment at that time also.

License is to be returned to the clerk’s office within 10  days after the ceremony. Please be sure person performing the ceremony  completes item number 21 through 25. Where are you located? Marriage Licenses may be obtained at the following locations:

What are your hours? Monday through Friday, 8:00 A.M. to 5:00 P.M.

Who can perform marriage ceremonies? Ordained ministers or elders in communion with some church, all judicial officers, clerks of the circuit courts, and notaries public of the State of Florida.

Can we be married there at the Clerk’s office? Yes. We perform ceremonies at the Clerk’s office for small parties. There is a charge of $30.00 for us to perform the ceremony. We ask that you be at the office no later than 4:00 P.M. for your license to be issued and the ceremony to be performed no later than 4:30 P.M.

If I get a marriage license in the State of Florida, can I take it to another state to be married? No.  The license is only good in the State in Florida and you must be married in the State of Florida.

How long is a marriage license good for? A Marriage License must be used within 60 days from the effective date. The effective date is located on your marriage license document.

How much does a Marriage License cost? The current fee for a Marriage License is $93.50, payable by cash, Mastercard, Visa, check, or money order payable to the Clerk of the Circuit Court.

How much does it cost for a certified copy of my marriage license? Each certified copy of a marriage license cost $3.00.

Will we have to read any material prior to our marriage license being issued? Yes.  Both the bride and the groom must read and make a sworn affidavit that they have read the Family Law Handbook created by the Family Law Section of the Florida Bar.

Is a waiting period required? If both the bride and the groom are not a resident of the State of Florida, then no waiting period is required and the fee for the marriage license is $93.50.  If either the bride or the groom are a resident of the State of Florida, then Florida requires a three day waiting period from the date you apply for you license before you can be married and the fee is $93.50.  If both the bride and the groom have taken a premarital preparation course within one year prior to applying for their marriage license, from a course provider registered with the Clerk of Courts, you will qualify for a reduction in the fee of $32.50, which will make the fee $61.00. The waiting period will then be waived.

How is the waiting period counted? The date the license is issued does count as the first day. You will need to wait two additional full days. You may then be married on the following day.  For example, assuming you are eligible for the three day waiting period: If you obtain your marriage license on Monday, then you can get married on Thursday. If you obtain your marriage license on Tuesday, then you can get married on Friday. If you obtain your marriage license on Wednesday, then you can get married on Saturday. If you obtain your marriage license on Thursday, then you can get married on Sunday. If you obtain your marriage license on Friday, then you can get married on Monday.

How can we avoid this three day waiting period? To avoid this three-day waiting period requirement, couples who are both Florida residents must complete a pre-marital preparation course given by a registered course provider.  By completing both the pre-marital preparation course and the Family Law Handbook, Florida residents will have their marriage license fee reduced from $93.50 to $61.00.  The pre-marital preparation course may be taken prior to applying for a marriage license.

Is a blood test required? The State of Florida does not require a blood test.

Must I be a Florida resident or a U.S. Citizen to apply for a marriage license? No.  Non-Florida residents and individuals who are not citizens of the United States of America may apply for a marriage license F.S. 741.04

What kind of identification do I need? Any legal document with your photo and date of birth on it: i.e. valid drivers license, military ID, alien registration card, or passport.

Will I need my social security number to apply for a marriage license? Yes.  Any person who has been issued a social security number shall provide that number when applying for a marriage license.

If I am not a U.S. Citizen, will I need my alien registration number issued by the United States Bureau of Citizenship and Immigration Services (USBCIS)? Any person who is not a citizen of the United States may provide either a social security number or an alien registration number if one has been issued by the United States Bureau of Citizenship and Immigration Services. Any person who is not a citizen of the United States and who has not been issued a social security number or an alien registration number is encouraged to provide another form of identification.

What is the age limit a person can get a marriage license without parental consent? The individual must be at least 18 years of age.

If I am under the age of 18, can I still get a marriage license? Per F.S. 741.0405, the clerk may issue a marriage license to an applicant if they are under the age of 18 but at least 16 year of age if one of the conditions listed below is met:

  • Written consent from the parent or guardian of the minor applicant, acknowledged before some officer authorized by law to take acknowledgments and administer oaths. However, the license shall be issued without parental consent when both parents of such minor are deceased at the time of making application.
  • When such minor has been married previously.

The county court judge, in his/her discretion, may issue a marriage license to an applicant if they are under 18 years of age if one of the conditions listed below is met:

  • Upon application of both parties sworn under oath that they are the parents of a child.
  • When the fact of pregnancy is verified by the written statement of a licensed physician.
  • Upon application of both parties sworn under oath that they are the expectant parents of a child.
  • Upon the female under 18 years of age sworn under oath that she is an expectant parent.

Do I need to bring my divorce papers or spouse’s death certificate with me to get my marriage license? No.  However, you must give us the complete and exact date of the divorce or date of death verbally.  If you do not know the exact dates, then copies of Florida marriage certificates, divorce decrees, and death certificates may be obtained by contacting the Florida Department of Health Office of Vital Statistics.  If the marriage, divorce, or death of your former spouse occurred outside the State of Florida, then copies of the marriage certificate, divorce decree, or death certificate may be obtained from the appropriate department in that state.

Do I need to bring witnesses? Witnesses are not required in the State of Florida.

Can I marry my relative? Per F.S. 741.21, A man may not marry any woman to whom he is related by lineal consanguinity, nor his sister, nor his aunt, nor his niece.  A woman may not marry any man to whom she is related by lineal consanguinity, nor her brother, nor her uncle, nor her nephew.

Can I marry a person of the same sex as I am? Per F.S. 741.212, For purposes of interpreting any state statute or rule, the term “marriage” means only a legal union between one man and one woman as husband and wife, and the term “spouse” applies only to a member of such a union.

Marriage Licenses – General Information

In order to obtain a marriage license in Duval County, a couple must apply together, in person, at the Duval County Clerk of Courts office. The marriage license is only good within the State of Florida. Both parties must be present with their State issued ID, military ID, or passport, as well as their Social Security cards.

If either applicant has been married previously, you will need to know the exact date of divorce, death, or annulment. If the marriage ended within the last sixty (60) days, you must bring proof showing how the marriage ended.

Applicants under eighteen (18) years of age must have consent from both parents, unless a Court order has given one parent sole custody, in which case they must have consent from the parent having sole custody. The consent must be provided at the time the application for a marriage license is made. Applicants under sixteen (16) years of age must have court approval, and should contact the Clerk of Court’s office for more information.

The fee for a marriage license is $93.50, and must be paid in cash only. Other forms of payment are not accepted. If both parties have taken a premarital class with a registered premarital course provider, the fee is reduced to $61.00.

Effective January 1st, 1999, there is a three (3) day waiting period for marriage licenses unless a premarital class has been taken from a registered premarital course provider. If both applicants are Non-Florida residents, then this waiting period shall be waived.

Issuance of marriage license

A County Judge or Clerk of the Circuit Court shall issue every marriage license. The County Judge or Clerk of the Circuit Court shall issue license, upon application of the license, if there appears to be no impediments to the marriage. (F.S. 741.01).

Written application required

No County Judge or Clerk of the Circuit Court in this state shall issue a license for the marriage of any person present unless shall be first presented and filed with him an affidavit in writing, signed by both parties to the marriage, made and subscribed before some person authorized by law to administer an oath, reciting the true and correct ages of such parties; unless both such parties shall be over the age of 18, except as provided in F.S. 741.0405 (F.S. 741.04)

Issuance in blank prohibited

It is unlawful for any County Court Judge or Clerk of the Circuit Court in the State to send out of his office any marriage license signed in blank to be issued upon application to persons not in the office of the County Judge or Clerk of the Circuit Court (F.S. 741.03)

Persons authorized to solemnize matrimony

  1. All regularly ordained ministers of the gospel or elders in communion with some church or other ordained clergy, all judicial officers, Clerk of the Circuit Court, and notaries public of this state may solemnize the rights of matrimonial contract, under the regulations prescribed by law.
  2. Any marriage which may be had and solemnized among the people called “Quakers or Friends”, in the manner and form used or practiced in their societies, according to their rites and ceremonies, shall be good and valid in law; and wherever the words “minister” and “elder” are used in this chapter, they shall be held to include all of the persons connected with the Society of Friends, or Quaker, who perform or have charge of the marriage ceremony according to their rites and ceremonies.

Marriage not to be solemnized without a License

Before any of the persons named in s. 741.07 shall solemnize any marriage, he or she shall require of the parties a marriage license issued according to the requirements of s. 741.01. Making sure the ceremony is performed between the “effective” and “expiration” date.

License must be certified and filed within ten (10) days

Within ten (10) days after solemnizing the marriage he shall make a certificate thereof on the license, and shall transmit the same to the office of the Clerk of the Circuit Court from which it was issued.

Time limit

The license must be used within sixty (60) days from the “effective date”.

What is required when applying for a marriage license and how much does it cost?

The fee is $93.50 if you do not take the premarital preparation course and you will have a three day waiting period before you can pick up your license. The license should be returned to our office within 10 days after the ceremony. There is no charge for the recording fee and there is no charge for the first certified copy. Additional certified copies cost $2.00.

Must I apply for a marriage license in the county I live in?

No. A Marriage License can be applied for and solemnized in any Florida County.

Who may perform Marriage Ceremonies?

All regularly ordained ministers of the gospel, elders in communion with a church, or other ordained clergy.

All Judicial Officers, including retired Judicial Officers, Clerks of the Circuit Court, and Notary Publics of this State.

Who is a regularly ordained minister?

A minister who has been recognized in the manner required by the regulations of the respective denomination to perform marriage ceremonies.

May a license be issued to a person 16 or 17 years of age?

A license may be issued to a person 16 or 17 years of age if both parents sign a written consent, if the minor has been married before or if both parents are deceased and there is no legal guardian. The age requirement can be waived by a County Judge for applicants that prove they are parents or expectant parents.

Can a minor, younger than 16 get a marriage license?

Florida Statute 741.0405(4) states that no license to marry shall be granted to any person under the age of 16 years, with or without the consent of the parents, except as provided in Florida Statute 741.0405(2) and (3).

Marriage  License Information

Requirements:

  • Both applicants must apply in person and bring a drivers license, passport or state issued identification card. If either applicant was previously married, the date the marriage ended by divorce or death is required.
  • The effective date of the license will not be valid until three (3) days after issuance if both partners do not attend the pre-marital course. Exceptions to the waiting period are non-Florida residents and persons asserting hardships.
  • Both applicants must be at least 18 years of age to apply without parental consent.
  • If either applicant is under the age of 18 years of age but at least 16 years of age, a birth certificate and proof of identification is required along with a notarized written consent of the parents or guardian. Consent forms are available at our office.
  • Applicants under 16 years of age must obtain a determination from a county judge.
  • No blood test is required.
  • The cost is $93.50 payable by cash, check or money order payable to the Clerk of Court. A reduction in the fee ($32.50) will be assessed for any couple that provides a valid certificate of completion of a pre-marital course (making the license $61.00).
  • The license must be used within sixty (60) days of issuance.
  • The license may be used in any county in the State of Florida.
  • The executed license must be returned within ten (10) days to our office.

Florida Statute 741.01 in part, states that the Clerk of Circuit Court acts as an agent for the State of Florida for issuing Marriage Licenses. What is needed to get a Marriage License?

Both parties must provide proof of the following:

  • Identification in the form of a drivers license, state ID or passport.
  • U.S. Citizens must provide their Social Security Number. Non citizens may provide a Social Security Number, or an Alien Registration Number issued by the Immigration and Naturalization Service.
  • Proof of age. Both parties must be at least 18 years of age.
  • An application form must be completed. If either party has been previously married, you must note on the application how and when the marriage ended.

  • The fee for the Marriage License is $93.50. This fee is reduced to $61.00 for Florida Residents who have completed a premarital preparation course as provided in Florida Statute 741.0305(5).

Do both parties have to be present at the Clerks Office to apply for a license?

Yes. Both parties must sign the application form and take an oath to the truthfulness of the information provided.

Is a blood test required?

No. A blood test is no longer required in the State of Florida.

Is there a waiting period for the issuance of a Marriage License?

Yes, Florida Statute 741.04 (3) says the effective date shall be delayed 3 days from the date of application unless Florida Residents present the following:

  1. Certificate of completion of a premarital preparation course from a qualified course provider listed with our office.
  2. Completion of the Family Law Handbook.
  3. A statement attesting to completion of the premarital preparation course and have read the Family Law Handbook.

There is no waiting period for out of state residents.

How long is the Marriage License valid?

Florida Marriage Licenses are valid for 60 days from the date issued.

Must I apply for a Marriage License in the County where I live?

No. A Marriage License can be applied for and solemnized in any Florida County.

Who may perform Marriage Ceremonies?

  • All regularly ordained ministers of the gospel, elders in communion with a church, or other ordained clergy.
  • All Judicial Officers, including retired Judicial Officers, Clerks of the Circuit Court, and Notary Publics of this State.
  • “Quakers” and “Friends” may perform marriages in the manner and form used and practiced in their societies.

Who is a regularly ordained minister?

A minister who has been recognized in the manner required by the regulations of the respective denomination to perform marriage ceremonies.

May I get married by a captain aboard a ship?

Yes. If the Captain is a Notary and the ship is in Florida Waters (within 3 geographic miles of the coastline) at the time of the ceremony.

May a marriage be solemnized without a license?

No. Florida Statute 741.08 states in part that the party solemnizing the marriage shall require a properly issued license before performing the ceremony, and within 10 days after the ceremony, he shall make a certificate thereof the license and shall transmit the same to the Clerk of the Circuit Court from which it was issued.

Can I be married in the Clerks Office?

Yes. Deputy Clerks are authorized and available during normal working hours Monday through Friday, to perform ceremonies. No appointment is necessary. The fee for this service is $30.00.

How long does it take to get a copy of the marriage record, and the costs?

You will receive a certified copy of the Marriage Certificate within 7 days after the officiator returns it to the Clerks Office to be recorded. There is no charge for the first copy. Additional certified copies cost $3.00.

Can people get a license to marry partners of their own gender?

Florida Statute 741.04 states in part that one applicant must be male and the other female.

Can a person marry someone to whom they are related?

Florida law prohibits a person marrying anyone to whom they are related by lineal consanguinity. The nearest degree of relations who may legally marry in the State of Florida is first cousins.

Do one or both applicants have to be U.S. Citizens?

No. There is no citizenship or residency requirements.

May a license be issued to persons 16 or 17 years of age?

  • With written consent from both parents or guardian.
  • If a minor has been previously married.
  • The age requirement can be waived by a County Judge for applicants that prove they are parents or expectant parents.
  • If both parents are deceased and there is no legal guardian.

Can a minor, younger than 16 get a Marriage License?

Florida Statute 741.0405(4) states that no license to marry shall be granted to any person under the age of 16 years, with or without the consent of the parents, except as provided in Florida Statute 741.0405 (2) and (3).

Requirements:
Residency: You need not be a resident of Florida to apply for a marriage license in Collier County. Age: Applicants must be 18 years of age. Anyone 16 or 17 years of age must have their parents’ consent.  (Consent forms available in Clerk’s Office). If an applicant is younger than 16 years of age, parental and/or judicial consent may be required depending upon the age and situation. Both applicants must appear in person at the time of application. Prior Marriage: If either party was married previously, the applicant is required to provide the date the marriage ended.Common Child(ren): Applicants with common child(ren) born in Florida must complete an Affirmation of Common Children Born in Florida Form. The completed form will be signed by both the bride and groom and submitted by the Clerk to the Department of Health with the original marriage certificate as required in F.S. 741.01 .

Identification: A driver’s license, government issued identification card or passport may be presented at the time the application is made. The application form includes listing your Social Security number.

Application Fee: A fee payable in cash, check or money order is required at the time the application is made. Fee: Marriage license fees may be discounted by presenting a marriage preparation course Certificate of Completion for both applicants from a  registered course provider at the time of application, as outlined in F.S. 741.0305 (5).Note: Course providers shall register with the Clerk of the Circuit Court by filling out and submitting a Registration Affidavit for Premarital Preparation Course

Waiting Period: The license must be used within 60 days from the “effective date” on the application. There is a 3-day waiting period for Florida residents ONLY**. This will be waived, when and if, both parties have completed a marriage preparation course and present the certificate of completion at the time of application. **There is no waiting period for out-of-state residents. Ceremony: The Marriage ceremony must take place within the state of Florida. A Florida notary public, an ordained clergy, the Clerk or Deputy Clerk of the Courts or judiciary, may perform a marriage ceremony. Recording of License: After the marriage, the person who performed the ceremony must return the license to the Recording Office, in person or by mail, within 10 days; at that time, it will be recorded in the Official Records. After being recorded, a certified copy will be returned to the newlyweds by mail, and the original license will be sent to the Office of Vital Statistics in Jacksonville, FL.

Chapter 741 of the Florida Statutes govern the issuance of Marriage Licenses.

A marriage license may be issued to anyone over 18 years of age as long as they have proper identification and all the information necessary to complete the application form. If either party has been married before, he/she must know the exact date (MM/DD/YY) the last marriage ended.

The issuance of a marriage license to anyone under 18 years of age but at least 16 years of age requires written parental consent from both parents. If one parent has been granted sole custody by a Court order, a certified copy of the Court order must be presented at the time of applying for the license. In the case of a pregnant female under the age of 18 without parental consent, the County Court Judge, in the exercise of his or her discretion, may issue a license to marry when the fact of pregnancy is verified by a written statement from a licensed physician.

No license shall be granted to any person under the age of 16 years, with or without the consent of parents, except when pregnancy is a factor.

The marriage license is valid for only 60 days and can be used anywhere in the State of Florida.

The Clerk’s office can perform the wedding ceremony for a fee of $30.00.  There is a $30.00 fee to correct any errors found after the license has been issued (signed by the bride and groom and the deputy clerk).  If an error is found after the license has been issued and/or recorded, this form, “Request to Modify Marriage License” must be filled out and signed before a notary or a deputy clerk and presented at the time of requesting correction.

Requirements for Florida Residents

  • both parties must appear together in person
  • must produce a valid photo identification such as a driver’s license or passport
  • the application fee is $93.50, payable with cash, check, money order or credit card
  • required 3 day waiting period (starts the day after the license is issued)
  • must know Social Security number (US Residents)

However, the completion of a 4 hour pre-marital preparation class will waive the 3 day waiting period and will reduce the application fee to $61.00. Both applicants must appear and provide the following information:

1. Proper Identification – one (1) of the following:

2. Social Security Number of both applicants.

  • A. If either applicant is not a U.S. Citizen, their passport or Resident Alien Card is required.

3. Premarital Preparation Course and Family Law Handbook requirements:

  • A. If both applicants are Florida residents, the Premarital Preparation Course must be completed within one (1) year prior to the date of application. The completion certificates must be presented at the time the license is issued. Both applicants must obtain and read or otherwise access the information contained in the Family Law Handbook and sign a statement attesting to the fact. Applicants will also be requested to complete a questionnaire. The three (3) day waiting period will be waived. The cost of the license will be $61.00.
  • B. Florida residents who have NOT completed the Premarital Preparation Course within one (1) year prior to the date of application and do NOT provide the completion certificates will not be issued a license until they have read the Family Law Handbook. The effective date will be delayed three (3) days from the date the license is issued. The cost of the license will be $93.50.
  • C. If both applicants are non-residents, there are no course requirements but both applicants must read the Family Law Handbook. There is no waiting period. The license will be $93.50.
  • D. If one (1) applicant is a Florida resident and one (1) applicant is a non-resident, the Florida resident must meet the course and handbook requirements or the license will be delayed three (3) days from the date the license is issued. The license will be $93.50.
  • E. Florida residents asserting a hardship may have the delayed effective date waived by the County Judge for good cause. The license will be $93.50.

4. If the last marriage ended by divorce, the month, day, and year of the final judgment is required.

5. If the last marriage ended by death, the month, day, and year of the deceased spouses death is required.

6. If either applicant is 16 or 17 years of age, you must provide parental consent from both parents. Parental consent may be provided by one parent if he or she has sole custody or the other parent is deceased. Parental consent is required unless a medical statement by a licensed physician is submitted as proof of pregnancy and presented to the County Court Judge. The County Court Judge at his or her discretion can issue a license to marry.

7. No person under 16 years of age may obtain a marriage license unless a medical statement as proof of pregnancy is presented to the County Judge and the County Judge approves such marriage.

8. The license is valid for sixty (60) days after the date of issuance and may be used anywhere in the State of Florida. If the license expires before the ceremony is performed, a new license and fee will be required.

9. A free certified copy of the marriage license will be provided either by mail to the address provided or in person within thirty (30) days from the date the license is received by the Clerk’s office. Any additional certified copies will be $3.00 each.

10. A Deputy Clerk may perform your ceremony for a fee of $30.00. It will be necessary to make an appointment for this service and specify which office you would like to have it performed at.
