The Clerk of the Circuit Court acts as an agent for the State of Florida for issuing licenses per Florida Statute 741. The Marriage License Department is here to answer your questions concerning obtaining a marriage license in Jefferson County. As a public service the Deputy Clerk may also perform ceremonies.

What do I need to do to get a marriage license? To obtain a marriage license both parties need to come in person to the Clerk’s office, bring their Valid Photo Identification, provide their social security numbers (Or Valid Passport) and pay the marriage license fee. In addition, if either party has previously been married, they must supply the date and reason that marriage ended. Each person applying for a marriage license must also read the “Family Law Handbook”. This is required by law. What type of identification is a marriage license applicant required to produce? Applicants are required to provide one of the following IDs, and that ID must include his/her date of birth:

1. A Florida identification card or driver’s license issued by the Florida Department of Highway Safety and Motor Vehicles. 2. A passport issued by the Department of State of the United States. 3. A passport issued by a foreign government if the document is stamped by the United States Immigration and Naturalization Service. 4. A driver’s license or an identification card issued by a public agency authorized to issue driver’s licenses in a state other than Florida, a territory of the United States, or Canada or Mexico. 5. An identification card issued by any branch of the armed forces of the United States. 6. An inmate identification card issued on or after January 1, 1991, by the Florida Department of Corrections for an inmate who is in the custody of the department. 7. An inmate identification card issued by the United States Department of Justice, Bureau of Prisons, for an inmate who is in the custody of the department. 8. A sworn, written statement from a sworn law enforcement officer as to the date of birth of an applicant and that the identification documents for an inmate in an institution of confinement were confiscated upon confinement and that the person named in the document is the person whose signature is to be notarized. 9. An identification card issued by the United States Immigration and Naturalization Service.

How much does it cost to get a license? The total cost for a license (including county and state fees) is $93.50. However, couples who have attended an approved premarital preparation class pay only $61.00. The provider has to be on a provider list pursuant to Florida Statute 741.0305(5) and the Certificate of Completion for the class must be presented to the Clerk.

Do I have to pay the fee in cash? Payment in full by cash, cashier’s check or credit card is required.

Do both parties have to be present at the Clerk’s office to apply for a license? Yes.

Do we have to have a blood test to apply for a license? No. Blood tests for marriages in Florida are not required.

How long does it take to get a license? Licenses are issued immediately. The process normally takes no more than 30 minutes. However, unless the couple has attended an approved premarital preparation class there is a three day waiting period before the license is effective and the marriage can take place. There is no waiting period for out of state residents.

What are the age restrictions for obtaining a marriage license? To obtain a license without parental consent, both the male and female must be at least 18 years of age (the 18-year minimum age does not apply to individuals who have been married previously, nor to applicants who are parents or expectant parents).

Can an individual who is younger than 16 get a marriage license from the Clerk’s Office with parental permission? Such an individual may apply for a license at the Clerk’s office. However, with or without parental permission, a marriage license to anyone under age 16 can only be issued upon approval of a county judge.

Is the signature of just one parent sufficient to qualify as parental permission for a minor to marry? No. The permission of one parent is sufficient ONLY if that parent has sole legal custody of the minor or if the other parent is deceased.

How long is the marriage license valid? Florida marriage licenses are valid for 60 days from their date of issue. They must be returned to the Clerk’s Office for recording within 10 days after the marriage is performed.

How long does it usually take to get a certified copy of our marriage record? Certified copies are normally received within 10 days after the completed marriage certificate is returned to the Clerk’s office for recording in the county’s official records.

How much does it cost for a certified copy of a marriage certificate? One certified copy is provided as part of the marriage license fee. There is no additional cost. Extra certified copies may be obtained for a fee of $3.00 each.

Do one or both of the marriage license applicants have to be American citizens? No. There is no citizenship requirement.

Do we have to make an advance appointment for a license? No. Licenses are issued without appointments during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday.

Can the Clerk’s Office perform the marriage for us? Yes. Deputy Clerk’s can perform a civil marriage ceremony. There is a charge of $30 for that service. Call (850) 342-0218 ext. 225 to make an advance appointment. You should bring two witnesses with you to the ceremony if possible. Rings are at the option of the parties.

My husband and I want to renew our vows. Do we need to get a license for this? No.

How do we go about renewing our marriage vows? Talk to your clergyman, chaplain, or other religious adviser or personal counselor.

Do I have to have my divorce papers (or spouse’s death certificate) in order to apply for a marriage license? You must be sure the divorce is final and you will need to know the date the judgement was signed. The application does require you to say when and how your last marriage ended (divorce, annulment, or death).

Do I have to bring a driver’s license or other form of official identification with me to obtain a marriage license? Yes, proper photo identification such as a driver’s license, Florida I.D. card, or passport is required.

Can a person marry someone to whom they are related? Florida law prohibits a person marrying anyone to whom they are related by lineal consanguinity. The nearest degree of relationships who may legally marry in the state of Florida is first cousins.

Can homosexuals obtain licenses to marry partners of their own gender? No. Florida law specifies that one applicant must be male and the other female.

Where is the Clerk’s Office located? Marriage Licenses are issued at the Clerk’s office located at the Jefferson County Courthouse, 1 Courthouse Circle, Monticello, Florida (32344).

Can I marry outside the State of Florida with a Florida marriage license? No. You can only use a Florida Marriage License in the State of Florida.

Can an ordained minister, active or retired judicial officer, circuit court clerk or notaries public from another state perform a marriage in Florida? Per Florida Statute 741.07, all regularly ordained ministers of the gospel or elders in communion with some church, or other ordained clergy, whether in this state or not, are authorized to perform marriages. However, active or retired judicial officers, circuit court clerks or notaries public from other states are not authorized to do so in Florida.

Who May Apply For A Marriage License?

  • Any male or female age 18 or over.
  • A minor whose parents are deceased and no guardian is appointed.
  • Minors, who under oath, swear that they are parents or expectant parents of a child. In addition, the pregnancy must be verified by a written statement of a licensed physician. When the fact of pregnancy is verified by the written statement of a licensed physician, the county court judge may, in his/her discretion, issue a license to marry.
  • A previously married minor.
  • A person age 16 or 17 with parental or guardian consent.

Where Consent Is Required, Is Consent Of Both Parents Required?

Yes, unless the parents are divorced and the custody and control is placed in one parent, then only the parent having such custody and control shall be required to give the written consent. Written consent of an incompetent parent is not required (Attorney General Opinion 49-122). All written consents must be acknowledged (notarized).

Is There A Waiting Period For Issuance Of The License?

Yes, a three day wait if you don’t take the four hour premarital preparation course from a registered provider.

Are Blood Tests And Physical Exams Required?

No. The law requiring these tests was abolished October 1, 1986.

Must I Apply For A Marriage License In The County Where I Live?

No, a marriage license may be applied for and solemnized in any Florida county.

Where Can I Apply For A Marriage License In Jackson County?

A marriage license may be obtained Monday through Friday, 8:00 am. to 4:30 p.m. at the Marriage Division of the Clerk of Circuit Court’s Office in the Jackson County Courthouse.

How Long Is A Marriage License Valid Once It Is Issued?

The marriage must be solemnized within sixty (60) days of issuance of the Marriage License. The ceremony can be performed anywhere in the State of Florida.

Who May Perform Marriage Ceremonies?

  • A regularly ordained minister or other ordained clergy;
  • Elders in communion with some church;
  • All judicial officers (Judges) of the State of Florida;
  • Clerks of Circuit Court and their deputies of the State of Florida; and
  • Notaries Public of the State of Florida.
  • In addition, the law provides that marriages may be performed among “Quakers” or “Friends”, in the manner and form used or practiced in their societies.
  • Who Is A “Regularly Ordained Minister”?

He/she is a minister who has been recognized in the manner required by the regulations of the respective denomination to perform marriage ceremonies.

May A Marriage Be Solemnized Without A License?

No, Section 741.08 F.S. states that the party solemnizing the marriage shall require a properly issued license before performing the ceremony.

When And Who Should Return The License To The Clerk?

A marriage cannot be officially recorded until the license is returned to the Clerk. It should be returned within 10 days after the wedding. The party who performed the marriage is responsible for returning the completed license.

Can I Be Married In The Clerk’s Office?

Yes. Dale Rabon Guthrie, Clerk of Courts, considers it an honor to perform wedding ceremonies and Deputy Clerks are authorized and available during normal working hours to perform marriage ceremonies. The fee for this service is set by Florida Statute and is currently $30.00. Please call for an appointment at (850) 482-9552.

Can I Pay For My Marriage License With A Personal Check?

In Jackson County, local checks are accepted for a marriage license. Checks should be made payable to: Dale Rabon Guthrie, Clerk of Courts.

Changing Information On Documents

If your marriage means a change in name and/or address, remember to make the following important notifications:

  • Florida Department of Highway Safety and Motor Vehicles, Division of Drivers License.
  • Your nearest Social Security office.
  • Your voter’s registration office.
  • Military Reserve commanding officer.
  • Beneficiaries: Members of your family are probably named as beneficiaries or joint owners on many of these documents (bank accounts, insurance policies, employment benefits, etc.) and you may wish to make your spouse the new beneficiary or joint owner.

Do both people need to come in together to apply for the marriage license?       

Yes.

What if I have been previously married?

If anyone of the applicants have been previously married, they must provide the date the last marriage ended. For example, if the marriage ended due to the death of a spouse, the date of death is required. If the marriage ended in divorce, the date of the Final Judgement of Dissolution of Marriage is required.

What type of ID is required?

A driver license or other acceptable identification such as passports or   employee identification cards.

What Is The Fee For A Marriage License?

The fee for a marriage license is $93.50. The Clerk retains $32.00 for taking the application, recording and preserving it as a permanent record of his/her office. However, the legislature provides that the remaining $61.50 be used to fund various state agencies and trust funds, as follows:

  • Department of Children and Family Services, Bureau of Vital Statistics $25.00
  • Family Courts Trust Fund $25.00
  • Displaced Homemaker Trust Fund $7.50
  • Department of Health  $4.00

Must I take the premarital preparation course?

No, but you must wait three days from the issuance date and pay the full price of $93.50.  “A man and a woman who intend to apply for a marriage license under s.741.04(Fla. Stat.), may, together or separately, complete a premarital preparation course of not less than 4 hours. Each individual shall verify completion of the course by filing with the marriage application a valid certificate of completion from the course provider, which certificate shall specify whether the course was completed by personal instruction, videotape instruction, instruction via other electronic medium, or a combination of those methods. s.741.0305(Fla. Stat.)” According to s.741.01(5) Florida  Statues, the course can be taken up to 1 year prior to the date of application for a marriage license. The cost of the course is to be paid by the applicant.

What is needed to get a Marriage License?

Both parties must provide proof of the following:

  • Identification in the form of a drivers license, state ID or passport.
  • U.S. Citizens must provide their Social Security Number. Non citizens may provide a Social Security Number, or an Alien Registration Number issued by the Immigration and Naturalization Service.
  • Proof of age. Both parties must be at least 18 years of age.
  • An application form must be completed. If either party has been previously married, you must note on the application how and when the marriage ended.
  • Pursuant to F.S. are required to read the Family Law Handbook before a license can be issued. Please click here to obtain Adobe Reader if you are unable to open the Handbook.
  • The fee for the Marriage License is $93.50. This fee is reduced to $61.00 for Florida Residents who have completed a premarital preparation course as provided in Florida Statute 741.0305(5).

Do both parties have to be present at the Clerks Office to apply for a license?

Yes. Both parties must sign the application form and take an oath to the truthfulness of the information provided.

Is a blood test required?

No. A blood test is no longer required in the State of Florida.

Is there a waiting period for the issuance of a Marriage License?

Yes, Florida Statute 741.04 (3) says the effective date shall be delayed 3 days from the date of application unless Florida Residents present the following:

  1. Certificate of completion of a premarital preparation course from a qualified course provider listed with our office.
  2. Completion of the Family Law Handbook.
  3. A statement attesting to completion of the premarital preparation course and have read the Family Law Handbook.

There is no waiting period for out of state residents.

How long is the Marriage License valid?

Florida Marriage Licenses are valid for 60 days from the date issued.

Must I apply for a Marriage License in the County where I live?

No. A Marriage License can be applied for and solemnized in any Florida County.

Who may perform Marriage Ceremonies?

  • All regularly ordained ministers of the gospel, elders in communion with a church, or other ordained clergy.
  • All Judicial Officers, including retired Judicial Officers, Clerks of the Circuit Court, and Notary Publics of this State.
  • “Quakers” and “Friends” may perform marriages in the manner and form used and practiced in their societies.

Who is a regularly ordained minister?

A minister who has been recognized in the manner required by the regulations of the respective denomination to perform marriage ceremonies.

May I get married by a captain aboard a ship?

Yes. If the Captain is a Notary and the ship is in Florida Waters (within 3 geographic miles of the coastline) at the time of the ceremony.

May a marriage be solemnized without a license?

No. Florida Statute 741.08 states in part that the party solemnizing the marriage shall require a properly issued license before performing the ceremony, and within 10 days after the ceremony, he shall make a certificate thereof the license and shall transmit the same to the Clerk of the Circuit Court from which it was issued.

How long does it take to get a copy of the marriage record, and the costs?

You will receive a certified copy of the Marriage Certificate within 7 days after the officiator returns it to the Clerks Office to be recorded. There is no charge for the first copy. Additional certified copies cost $3.00.

Can people get a license to marry partners of their own gender?

Florida Statute 741.04 states in part that one applicant must be male and the other female.

Can a person marry someone to whom they are related?

What is needed to get a marriage license?

Both parties must provide proof of the following: Age: both parties must be at least 18 years of age. Identification: in the form of a valid driver’s license, state ID or passport. U.S. citizens must provide their Social Security Number. Non-citizens may provide a Social Security Number or an Alien Registration Number issued by the Immigration and Naturalization Service. An application form must be completed. If either party has been previously married, you must note on the application how and when the marriage ended. The nonrefundable fee for the marriage license is $93.50. This fee is reduced to $61.00 for Florida residents who have completed a premarital preparation course.

HIGHLANDS COUNTY MARRIAGE LICENSE INFORMATION

Marriage License Provider List

Effective January 1, 1999 the following is required for obtaining a marriage license.

Both parties are to appear in the Clerk’s Office and sign the application.  If it is impossible for one person to appear in the Clerk’s Office, due to hospitalization or incarceration, call (863) 402-6587 to find out the information needed on the application, so that when you apply you can provide the clerk with the necessary information about that person.  Payment is required when applying for the license.  The application may be delivered to the person, to be signed in the presence of a Notary Public.  If incarcerated, you must have approval by the correctional institution before applying for the marriage license.

The legal age for marriage without parental consent is eighteen (18) years of age.  The legal age for marriage, with parent’s consent, is sixteen (16). The marriage application may not be issued, for anyone under the age of sixteen, unless the bride has a doctor’s certification that she is pregnant.  At that time, both the groom and bride will sign the affidavit stating that they are the parents of an expected child, and the parent(s) will sign consent(s) to the marriage. If the bride has a doctor certificate of pregnancy, whether or not the parents consent to the marriage, a hearing will be held before the county judge with proper notice to the parent(s).

Proper identification is needed.  Identification requirements are as follows:

Couples must be prepared to give their Social Security number.  No blood test is required

FOR U.S. CITIZENS: Driver’s License, Birth Certificate, Passport, or Florida State I.D. Card

FOR NON-CITIZENS: Resident Alien Card, Birth Certificate, Passport from native country, or any card issued by Immigration and Naturalization Services.

Couples who are Florida Residents have a choice of one of the following:

  1. Wait three days after application to use marriage license.
  2. Take a premarital course and obtain the license with no waiting period.

There is a handbook that has been created by the Family Law Section of the Florida Bar that the couple will receive when they obtain their license. All applicants are required to sign an affidavit stating whether they did or did not take the premarital course, and did receive the handbook.

If a couple decides to take the premarital course, they will need to do the following:

Take the course before applying for the license.  After taking the course they each will need to obtain a certificate to bring with them. Couples do not have to take the course together, it can be taken separately.  If the couple takes the course, they will get a $32.50 reduction on the cost of the license.  They may have to pay for the course (prices are set by the provider of the course).

If both are Non-Florida Residents they will be exempt from the three-day waiting period and will be able to obtain their license and have the wedding ceremony the same day, there is no reduction in the cost.

Individuals who wish to teach the course must come to the Highlands County Courthouse to obtain a Provider Affidavit that must be notarized and returned along with a copy of their license that qualifies them to teach the course.  The following is a list of qualified instructors as stated in Florida Statute 741.0305(3)(a):

  1. A Psychologist licensed under chapter 490
  2. A Clinical Social Worker licensed under chapter 491
  3. A Marriage and Family Therapist licensed under chapter 491
  4. A Mental Health Counselor licensed under chapter 491
  5. An Official Representative of a religious institution, which is recognized under s.496.404 (20), if the representative has relevant training.
  6. Any other provider designated by a Judicial Circuit, including, but not limited to, school counselors who are certified to offer such courses.

Each premarital preparation course provider shall furnish each participant who completes the course with a certificate of completion specifying the name of the participant, the date of completion and whether the course was conducted by personal instruction, videotape instruction or instruction via other electronic medium, or by a combination of these methods.

 

If there has been a recent divorce (within six months), you must show a copy of the Final Judgment.  If you have been divorced longer than six months, we do not require proof, but you must be prepared to give us the date the last marriage ended.  If the bride has had her maiden name restored, she must bring in a copy of the divorce papers stating her name was restored.

The total cost of a marriage license is as follows:

  • Couple, residents, both took course:  $ 61.00   no waiting period
  • Couple, residents, no course:              $ 93.50   3 day waiting period
  • Couple, residents:                                  $ 93.50   3 day waiting period

This includes two certified copies of the license, which are mailed to you.  The original is sent to the Bureau of Vital Statistics for recording and permanent record retention. Any additional certified copies needed may be obtained for an additional $3.00 each.

A self-addressed, stamped envelope is included with the license for the return of the original to this office for recording.  The person performing the ceremony and the witnesses must sign the original, and the appropriate lines completed.

Any ordained minister, Notary Public, or authorized Deputy Clerk, may perform marriages.

The Marriage License Division can perform ceremonies Monday through Friday, 8:00 am to 5:00 pm, but we ask that you come in no later than 4:30 pm to allow for sufficient time to perform the ceremony.

The cost of the ceremony is $30.00.

Marriage Licenses

Marriage licenses are handled by the Clerk’s Office.  To obtain a marriage license both parties must complete a marriage application (Marriage Kiosk link below) and must be 18 years of age or older and provide proof of their age, identification in the form of a driver’s license, state ID, or passport and either a social security card or an alien registration number issued by the Immigration and Naturalization Service if the party is not a U.S. citizen.  If the applicants are 16 or 17 years of age they must provide written consent of both parents or legal guardians.  Individuals under the age of 16 may not obtain a marriage license unless approved by the County Judge.

The fee for a marriage license is $93.50 and there is a three (3) day waiting period for Florida residents; there is no waiting period for non-residents.  Florida residents who have completed a premarital preparation course and can provide completion certificates will only be required to pay $61.00 and the three (3) day waiting period will be waived.  Please click here for a list of course providers.  All Florida residents are also required to read the Family Law Handbook (English)/(Spanish) whether or not the premarital preparation course has been completed.

Personal checks are not accepted for marriage licenses; cash or credit cards are accepted.

Once a marriage license is issued, it is valid for 60 days and the marriage ceremony must be performed within that time or the license will be voided.  Marriage ceremonies may be performed by:

  • All regularly ordained ministers of the gospel, elders in communion with a church, or other ordained clergy;
  • All judicial officers, including retired judicial officers, Clerks of the Circuit Courts, and public notaries of this state; and
  • “Quakers” or “Friends” may perform marriages in the manner and form used by their specific beliefs.

The Clerk’s Office also performs marriage ceremonies in the Ceremony Room, Room 362, for a $30.00 fee.

Once the ceremony is performed, the marriage certificate and a certified copy of the marriage certificate will be mailed to the address listed on the application within 30 days.  Additional certified copies cost $3.00 per document.

Per Florida law, the Clerk’s Office prohibits the issuance of a marriage license for parties of the same gender and for related individuals.

HENDRY COUNTY FLORIDA______MARRIAGE LICENSE______PUBLIC NOTICE

Effective January 1, 1999, all Florida residents who apply for a marriage license will have a three-day waiting period and must read a marriage handbook available at the Clerk’s office. To avoid this three-day requirement, couples must complete a pre-marital preparation course (given by a course provider registered with the Hendry County Clerk of the Circiut Court). How is the waiting period counted?   The date the license is issued does not count as the first day. You will need to wait two additional full days. You may then be married on the following day. For example, assuming you are eligible for the three day waiting period: If you obtain your marriage license on Monday, then you can get married on Thursday. Marriage Information

Effective June 3, 2010, Florida Statute 741.01 was amended by Senate Bill 694 to allow both parties to the marriage to state under oath in writing if they are the parents of a child born in Florida and to identify the children they have in common. Applicants that have a child or children in common should provide birth certificate(s) for the child(ren) when applying for a marriage license.
Both applicants must appear and provide the following information:
  1. Proper Identification – one (1) of the following:
    1. Drivers License
    2. State ID Card
    3. Birth Certificate (Must be in English, if in another language certificate must have a notarized affidavit of translator.
    4. Passport
  2. Social Security Number of both applicants:
    1. If a citizen, both applicants are required to provide Social Security numbers.
    2. If either applicant is not a U.S. Citizen, a Social Security number or Alien Registration number is required.
  3. Attend a Premarital Preparation Course, review the Family Law Handbook or wait the (3) day waiting period:
    1. If both applicants are Florida residents and choose to have the (3) day waiting period waived they must attend and complete a Premarital Preparation Course that must be completed within one (1) year prior to the date of application. The completed certificates must be presented at the time the license is issued. Both applicants must obtain and review or otherwise access the information contained in the Family Law Handbook and sign a statement attesting to the fact. The three (3) day waiting period will be waived. The cost of the license will be $61.00.
    2. Florida residents who have NOT completed the Premarital Preparation Course and do NOT provide a completed certificate will have a (3) day waiting period from the date the license is issued.  Both applicants must obtain and review the Family Law Handbook or otherwise access the information on the website and sign a statement attesting to the fact.  The cost of the license will be $93.50.
    3. If both applicants are non-residents, the Premarital Preparation Course and the (3) day waiting period is waived.  But both applicants must review the Family Law Handbook or otherwise access the information on the website and sign a statement attesting to the fact.  The cost of the license will be $93.50.
    4. If one (1) applicant is a Florida resident and one (1) applicant is a non-resident, the Florida resident must meet the course and handbook requirements or the license will be delayed three (3) days from the date the license is issued. The license will be $93.50.
    5. Florida residents asserting a hardship may have the delayed effective date waived by the County Judge for good cause. The license will be $93.50.
  4. If the last marriage ended by divorce, the month, day, and year of the final judgment is required or if by death, the month, day, and year the spouse deceased.
  5. If either applicant is 16 or 17 years of age, they must provide parental consent from both   parents. If either parent has sole custody, you must provide a certified copy of the order awarding sole custody. A death certificate is required for a deceased parent.
  6. No person under 16 years of age may obtain a marriage license unless a medical statement as proof of pregnancy signed by the Doctor is presented to the County Judge and the County Judge approves such marriage.
  7. The license is valid for sixty (60) days after the date of issuance and may be used anywhere in the State of Florida. If the license expires before the ceremony is preformed, a new license and fee will be required.
  8. A certified copy of the marriage license will be mailed to the address provided within thirty (30) days from the date the license is received by the Clerk’s office. Any additional certified copies will be $3.00 each.
  9. A Deputy Clerk may perform your ceremony for a fee of $30.00. We request that all ceremonies be performed between 8:30 a.m. to 12 Noon and from 1:00 p.m. to 4:30 p.m. Monday through Friday excluding Court Holidays.

Marriage Licenses

A couple wishing to be married must be prepared to provide their Social Security numbers or any other available identifications numbers, such as driver license numbers or other photo IDs (passport, military ID) to the Clerk’s office to apply for a marriage license.

What if I have been married before? If either applicant has been previously married, the exact date of divorce, death or annulment must be presented as well as the state and county where the divorce took place.

What are the procedures for underage marriages? Applicants must be18 years old to apply for a marriage license.  Underage applicants must have parental consent from both parents unless the court has given one parent sole custody.  The order would need to be presented at the time of application.  Applicants under the age of 16 must have court approval.

New Marriage Law as of January 1999 Any couple, if one or both parties are a Florida resident, must take a four hour premarital preparation course or wait three days before the marriage license goes into effect. To receive a waiver of the new three-day waiting period, a premarital preparation course must be completed within one year prior to obtaining a marriage license and a valid certificate of completion must be presented to the Clerk’s office. Taking the premarital preparation course also lowers the application fee.

If all of the course requirements are met on the day of application, the marriage license will be issued and will also be effective the same day. If the course requirements are not met on the date of application, the marriage license will be issued but will not be effective until three days from the issue date. The expiration date will be 60 days from the issued date and will appear on the license.

Recording of License After the court issues the marriage license, the license is valid for 60 days. The marriage ceremony must be held within that 60 day timeframe for the license to be valid. After the ceremony is preformed the marriage license must be sent or brought to the court, usually that is done by the person who preformed the ceremony.  It will then be recorded in the Official Records and an official copy sent to the new couple.

License Fee The fee for a marriage license is $93.50.  There is an exception if both parties are Florida residents and have provided proof of a premarital class with a certified provider.  The fee is reduced to $61.
