Who May Issue a Marriage License Every marriage license shall be issued by a county judge or clerk of the circuit court under his hand and seal. The county judge or clerk of the circuit court shall issue such license, upon application for the license, if there appears to be no impediments to the marriage. [Florida Statute 741.01]

Written Application Required No county court judge or clerk of the circuit court in this state shall issue a license for the marriage of any person unless there shall be first presented and filed with him an affidavit in writing, signed by both parties to the marriage, made and subscribed before some person authorized by law to administer an oath, reciting the true and correct ages of such parties; unless both such parties shall be over the age of 18, except as provided in Florida Statute 741.0405. [Florida Statute 741.04]

Issuance in Blank Prohibited It is unlawful for any county court judge or clerk of the circuit court in the state to send out of his office any marriage license signed in blank to be issued upon application to persons not in the office of the county judge or clerk of the circuit court. [Florida Statute 741.03]

License Must Be Certificated and Filed Within 10 Days Before any authorized person shall solemnize any marriage, he shall require of the parties a marriage license issued according to requirements of Florida Statute 741.01, and within 10 days after solemnizing the marriage he shall make a certificate thereof on the license, and shall transmit the same to the office of the county judge or clerk of the circuit court from which it issued. Marriage License Law

In Florida, the Clerk of the Circuit Court is the issuing agent for marriage licenses.

Any couple, if one or both parties is a Florida resident, may take a 4-hour premarital preparation course or wait three (3) days before the marriage license goes into effect. To receive a waiver of the three-day waiting period, a premarital preparation course must be completed within one year prior to obtaining a marriage license and a valid certificate of completion must be presented to the Clerk’s Office. Taking the premarital preparation course also lowers the standard fee.

Additionally, the couple must read and sign a statement that they have read the Family Law handbook or Manual de Derecho Familiar.

If all of the course requirements are met on the day of application, the marriage license will be issued and also be effective the same day. If the course requirements are not met on the date of application, the marriage license will be issued but will not be effective until three (3) days from the issue date. The expiration date will be sixty (60) days from the effective date and will appear on the license.

Notice: Florida Law Update FS 741.01 If you have a common child who was born in the State of Florida – there is an additional form that will be submitted to the Florida Department of Health . This will not be recorded and will be submitted along with your Marriage License once returned to our office. There is an additional fee of $2.00.

Who Can Apply for a Marriage License?

  • Any male or female 18 years of age or older.
  • A minor whose parents are deceased and has certified copies of both death certificates.
  • With a judge’s approval, minors, who must swear under oath, that they are parents or expectant parents of a child.
  • A previously married minor.
  • Any male or female 16-17 years of age with both parents’ or legal guardians’ consent.

What Do We Need to Bring When We Apply for a Marriage License?

Both the bride-to-be and the husband-to-be need to be present when applying for a marriage license. Depending on which category applies to you, you will need to bring the following information:

Applicants 18 years of age or older:

  • Valid government photo identification that shows the applicant’s date of birth (driver’s license, state ID, military ID, or passport)
  • You must know your Social Security Number, if applicable.
  • If previously married, you must provide the day, month, and year the previous marriage ended.
  • Your signature will be required on the application.

Applicants 16-17 years of age must present EACH of the following:

  • Valid government photo identification that shows the applicant’s date of birth (driver’s license, state ID, military ID, or passport)
  • You must know your Social Security Number, if applicable.
  • Certified copy of your birth certificate showing both parents’ names.
  • Notarized consent form of both parents or consent of one parent in the case of divorce if the custodial parent has the authority to grant permission for the non-custodial parent. Contrary To Widely Held Beliefs, Romance Can Last In Long-Term Relationships, Say Researchers

Romance does not have to fizzle out in long-term relationships and progress into a companionship/friendship-type love, a new study has found. Romantic love can last a lifetime and lead to happier, healthier relationships.

WASHINGTON – Romance does not have to fizzle out in long-term relationships and progress into a companionship/friendship-type love, a new study has found. Romantic love can last a lifetime and lead to happier, healthier relationships.

“Many believe that romantic love is the same as passionate love,” said lead researcher Bianca P. Acevedo, PhD, then at Stony Brook University (currently at University of California, Santa Barbara). “It isn’t. Romantic love has the intensity, engagement and sexual chemistry that passionate love has, minus the obsessive component. Passionate or obsessive love includes feelings of uncertainty and anxiety. This kind of love helps drive the shorter relationships but not the longer ones.”

These findings appear in the March issue of Review of General Psychology, published by the American Psychological Association.

Acevedo and co-researcher Arthur Aron, PhD, reviewed 25 studies with 6,070 individuals in short- and long-term relationships to find out whether romantic love is associated with more satisfaction. To determine this, they classified the relationships in each of the studies as romantic, passionate (romantic with obsession) or friendship-like love and categorized them as long- or short-term.

The researchers looked at 17 short-term relationship studies, which included 18- to 23-year-old college students who were single, dating or married, with the average relationship lasting less than four years. They also looked at 10 long-term relationship studies comprising middle-aged couples who were typically married 10 years or more. Two of the studies included both long- and short-term relationships in which it was possible to distinguish the two samples.

The review found that those who reported greater romantic love were more satisfied in both the short- and long-term relationships. Companion-like love was only moderately associated with satisfaction in both short- and long-term relationships. And those who reported greater passionate love in their relationships were more satisfied in the short term compared to the long term.

Couples who reported more satisfaction in their relationships also reported being happier and having higher self-esteem.

Feeling that a partner is “there for you” makes for a good relationship, Acevedo said, and facilitates feelings of romantic love. On the other hand, “feelings of insecurity are generally associated with lower satisfaction, and in some cases may spark conflict in the relationship. This can manifest into obsessive love,” she said.

This discovery may change people’s expectations of what they want in long-term relationships. According to the authors, companionship love, which is what many couples see as the natural progression of a successful relationship, may be an unnecessary compromise. “Couples should strive for love with all the trimmings,” Acevedo said. “And couples who’ve been together a long time and wish to get back their romantic edge should know it is an attainable goal that, like most good things in life, requires energy and devotion.”

What is needed to get a Marriage License?

Both parties must provide proof of the following:

  • Identification in the form of a drivers license, state ID or passport.
  • U.S. Citizens must provide their Social Security Number. Non Citizens may provide a Social Security Number or an Alien Registration Number issued by the Immigration and Naturalization Service.
  • Proof of age. Both parties must be at least 18 years of age.
  • An application form must be completed. If either party has been previously married, you must note on the application how and when the marriage ended.
  • The fee for the Marriage License is $93.50. This fee is reduced to $61.00 for Florida Residents who have completed a premarital preparation course as provided in Florida Statute 741.0305(5) .

Do both parties have to be present at the Clerks Office to apply for a license?

Yes. Both parties must sign the application form and take an oath to the truthfulness of the information provided.

Is a blood test required?

A minister who has been recognized in the manner required by the regulations of the respective denomination to perform marriage ceremonies.

May I get married by a captain aboard a ship?

Yes. If the Captain is a Notary and the ship is in Florida Waters (within 3 geographic miles of the coastline) at the time of the ceremony.

May a marriage be solemnized without a license?

No. Florida Statute 741.08 states in part that the party solemnizing the marriage shall require a properly issued license before performing the ceremony, and within 10 days after the ceremony, he shall make a certificate thereof the license and shall transmit the same to the Clerk of the Circuit Court from which it was issued.

Can I be married in the Clerks Office?

No. The Levy County Clerk does not provide this service.

How long does it take to get a copy of the marriage record, and the costs?

You will receive a certified copy of the Marriage Certificate within 7 days after the officiator returns it to the Clerks Office to be recorded. There is no charge for this copy. Additional certified copies cost $3.00.

Can people get a license to marry partners of their own gender?

Florida Statute 741.04 states in part that one applicant must be male and the other female.

Can a person marry someone to whom they are related?

Florida law prohibits a person marrying anyone to whom they are related by lineal consanguinity. The nearest degree of relations who may legally marry in the State of Florida is first cousins.

Do one or both applicants have to be U.S. Citizens?

No. There are no citizenship or residency requirements.

May a license be issued to persons 16 or 17 years of age?

  • With written consent from both parents or guardian.
  • If minor has been previously married.
  • A County Judge can wave the age requirement for applicants that prove they are parents or expectant parents.
  • If both parents are deceased.

Can a minor younger than 16 get a Marriage License with parental permission?

Florida Statute 741.0405(4) states that no license to marry shall be granted to any person under the age of 16 years, with or without the consent of the parents, except as provided in Florida Statutes 741.0405(2) and 741.0405(3).

MARRIAGE LICENSES

In Leon County, the Clerk’s Office is the issuing agent of Marriage License for the State of Florida.  The requirements for single adults to obtain a marriage license is for the couple to come in person to the Clerk’s office, bring with them their drivers license or other acceptable picture identification- must be a Government issued I.D. (passport, military I.D.) along with their social security number. If either applicant has been previously married, the exact date of divorce, death or annulment must be presented. If either occurred within the last thirty days documentation must be provided at the time of application.  Applicants must be (18) years old to obtain a marriage license. Underage applicants must have parental consent from both parents unless one parent has been given sole custody by court order. The order would have to be provided at the time of application. Applicants under sixteen must have court approval.

ISSUANCE MARRIAGE LICENSE

A county judge or clerk of the circuit court shall issue every marriage license. The county judge or clerk of the circuit court shall issue such license, upon application for the license, if there appears to be no impediments to the marriage. (F.S. 741.01)

WRITTEN APPLICATION REQUIRED

No county judge or clerk of the circuit court in this state shall issue a license for the marriage or any person unless there shall be first presented and filed with him an affidavit in writing, signed by both parties to the marriage, made and subscribed before some person authorized by law to administer an oath, reciting the true and correct ages of such parties; unless both such parties shall be over the age of 18, except as provided in F.S. . 741.0405 (F.S. 741.04)

ISSUANCE IN BLANK PROHIBITED

It is unlawful for any county court judge or clerk of the circuit court in the state to send out of his office any marriage license signed in blank to be issued upon application to persons not in the office of the county judge or clerk of the circuit court. (F.S. 741.03)

PERFORMANCE OF MARRIAGES

  1. All regularly ordained ministers of the gospel or elders in communion with some church or other ordained clergy, and all judicial officers, clerk of the circuit court, and notaries public of this state may solemnize the rights of matrimonial contract, under the regulations prescribed by law.
  2. Any marriage which may be had and solemnized among the people called “Quakers or “Friends”, in the manner and form used or practiced in their societies, according to their rites and ceremonies, shall be good and valid in law; and whenever the words “minister” and “elder” are used in this chapter, they shall be held to include all the persons connected with the Society of Friends, or Quakers, who perform or have charge of the marriage ceremony according to their rites and ceremonies. (F.S. 741.07)

LICENSE MUST BE CERTIFIED AND FILED WITHIN 10 DAYS

Before any authorized person shall solemnize any marriage, he shall require of the parties a marriage license issued according to requirements of Florida Statute 741.01, making sure the ceremony is performed between the “effective date” and the “expiration date”. Within 10 days after solemnizing the marriage he shall make a certificate thereof on the license, and shall transmit the same to the office of the clerk of the circuit court from which it was issued.

TIME LIMIT

The license must be used within sixty (60) days from the “effective date”. Below is the effective date criterion:

  • If both parties are Florida residents, they must both attend a premarital class and present completion certification of the class to the clerk at the time of application. Completion of the class waives the waiting period otherwise there is a three day waiting period from the date of issue before the marriage ceremony may take place.
  • If only one of the applicants is a Florida resident and the Florida resident takes the course, there is no waiting period.
  • If both parties are out of state residents, there is no waiting period.

SOLEMNIZATION

A regularly ordained clergy, judiciary, State of Florida Notaries, the Clerk of the Circuit Court and Deputy Clerks may perform a marriage ceremony.

MARRIAGE LICENSE FEE

The fee for a marriage license is $93.50. The exception is if both parties are Florida residents and have provided proof of a premarital class with a provider certified by the Clerk. The fee is then $61.00.   Fees may be paid in cash, check or credit card.

Lee County Marriage License Information

If you are getting married in the State of Florida, you may obtain your marriage license in any county within the State. Both the bride-to-be and the husband-to-be need to be present when applying for a marriage license, no exceptions. Our offices are located at the County Administration Building, 2115 Second Street, 2nd Floor, Fort Myers, FL. The Lee County Clerk of Courts Recording Office is open from 8:00 a.m. to 5:00 p.m. Monday through Friday. You can apply for a license or have the marriage ceremony performed in the office anytime between 8:00 a.m. and 5:00 p.m. If you are unable to find the answer to your question on our website please call 239-533-5007 for more information.
Florida Residents have a 3 day waiting period unless they meet the following criteria:
  • If both the Bride and the Groom are Florida Residents and have attended a 4 hour pre-marital course, they do not have a three day waiting period.  The Bride and Groom must provide proof of course completion when applying for the marriage license.  The course provider must list the hours completed for the counseling and the letter must be presented on the company/church letterhead.
  • All area course providers must be registered with the Lee County Clerk of Courts per Florida Statute 741.0305 (5).  Click here for instructions on how to register.  Click here  for a list of course providers.
  • If both Bride and Groom are not Florida Residents, you do not need to provide proof of pre-marital counseling.  As non-residents of the State of Florida, you do not have a waiting period.

eMarriage Application

eMarriage is an online marriage license pre-application program that will save you time when you come to the Clerk’s Office. By using our eMarriage application, you are filling out, at your convenience, all the necessary information required by the State of Florida to obtain a marriage license. You save time because you will not have to fill out a paper  marriage license application at the Clerk’s Office. Your online application is valid for 60 calendar days from the day it is submitted. Please note there is a three (3) day waiting period for Florida residents that have not completed a premarital preparation course from a qualified course provider registered with the Lake County Clerk of Court. The three (3) day wait begins once the couple appears in front of the marriage license clerk to complete the application process.

Using the eMarriage Application System

  1. Read the disclaimer to understand that by filling out the online application, you must still appear before the Clerk and meet the State of Florida’s requirements for a marriage license. Simply completing the online form does not mean you are married.
  2. Enter information in all the required fields and submit. Your information will go into the Clerk’s queue.
  3. You will receive an on-screen confirmation that you have successfully completed the online application.
  4. Within 60 days of completing the online application, the bride and groom must come together to the Marriage License/Passport Department with proper identification and form of payment.
  5. The three (3) day waiting period does not begin until the couple appears before a marriage license clerk to complete the application process.
  6. At that time, the Clerk will determine if your application can be accepted or rejected.

6 Signs Your Marriage Is Headed For Divorce

If you are married, having problems and sticking your head in the sand, where is your marriage headed? Divorce court! I recently worked with a couple who were in year 21 of their marriage. According to both there had been trouble from “day one.”

Twenty-one year’s worth of problems that should have been dealt with starting at “day one.” Not dealing with their problems as the problems came up led to years of built-up resentment for both. Hurt feelings, anger and emotional detachment from each other meant it would take a lot of effort to get the marriage back on track.

If you love your spouse and are committed to your marriage, do not ignore the follow six signs of impending divorce:

1. You fantasize about a life without your spouse.
I have a friend who recently divorced. For years before the marriage fell apart completely she spent a lot of time daydreaming about how much better life would be without her husband. This isn’t unusual, but if it is something you do often and with great abandon, it is time to seek help from a marital therapist.

Talk with your spouse about whatever it is that is causing you to long for the single life. It won’t be a pleasant conversation, but your spouse should be given a heads up and your marriage (especially if you have children) deserves the second chance it might get through counseling.

2. The bad outweighs the good.
Problems in a marriage feed on inactivity. If you have problems and don’t seek solutions, the bad will soon outweigh the good. Marriages can become breeding grounds or a vicious cycle of one problem after another. Do you and your spouse a favor seek help and advice from a trained professional before the scales tip too far and you find yourself with unsolvable problems.

3. You don’t share your thoughts and feelings.
Yes, some things are sacred — you don’t need to share every thought or feeling — but you aren’t doing your marriage a favor if you don’t share marital unhappiness with your spouse. Unless you feel there is a threat of abuse (physical or verbal retaliation),communication is an important way to relieve stress and build a healthier bond with your spouse. And problems can’t be worked through unless you are both aware of the problem.

4. Engaging in negative defense mechanisms.
Does your spouse become overly defensive when you express a concern? Do you dismiss your spouse’s needs? Does your spouse criticize your beliefs, or engage in stonewalling tactics? If so, you are at high risk of divorce. If either of you engage in negative defense mechanisms when attempting to solve a problem, you are building more problems and solving nothing. This can be the kiss of death for your marriage.

5. You feel alone in solving marital problems.
My ex engaged in negative defense mechanisms. He avoided conflict at all cost. He was a master at walking away, refusing to communicate and dismissing my concerns over problems in the marriage. He kept his head so far up his butt he could see his tonsils!

If there were problems, I was responsible for solving those problems…with no help from him. He handed me full responsibility for our relationship on a silver platter and when I failed to solve the problems, as he saw them but failed to share with me, the marriage was over.

It takes two to make problems and two to solve problems. Hopefully you are married to someone who understands this concept.

6. One desires sex and the other doesn’t.
A marriage that lacks sexual intimacy and affection will either end up in divorce or end up being a marriage of convenience. Nothing is more damaging to a marriage or the self-esteem of a spouse than having a partner reject them sexually.
